Terms of Service
These Terms of Service ("Terms") are an agreement between you and Denis Salaev ("we", "us") for the iPhone app Speaker Rescue: Water Eject (the "app"). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.
1. Who can use the app
You must be at least 13 years old. If you are under the age of majority where you live, use the app and make purchases only with the permission of a parent or guardian.
2. What the app does, and what it does not
Speaker Rescue plays sound through your iPhone's speaker (a low tone and a frequency sweep) to help push water and dust out of the speaker openings. It also includes tools to test your audio: a sound level meter, Noise Log, dB Camera, stereo, microphone, bass, vibration and frequency tests, a tone generator, and tips.
- It does not repair, dry, clean the inside of, or waterproof your phone. Sound can help move water or dust that sits in the speaker openings; it cannot remove moisture from inside the device or fix damage.
- There is no guarantee. Results depend on your device and the situation. We do not promise that water or dust will come out, that your sound will improve, or that any problem will be fixed.
- The before and after sound check and the other measurements use your iPhone's built-in microphone. They are approximate and are not calibrated measurements. Do not rely on them for safety, workplace, legal or professional purposes.
- The app is not a medical device and does not test or assess your hearing or health.
3. Safe use
- Protect your hearing. The app can play loud sound and, with your confirmation, raise the phone's volume to maximum during a cleaning. Never hold the phone to your ear, or wear headphones or earbuds, while a cleaning is running. Keep it away from children and pets.
- Stop at any time. Sessions are short, but you are in control: if a sound is uncomfortable, stop the session and lower the volume.
- The app tries to restore your previous volume afterwards, but check it yourself before you put anything on your ears.
- If your device has been in liquid, follow the device maker's instructions (see Apple Support) and have it checked if it does not work normally.
- Do not use the app while driving or when you need to hear your surroundings.
4. Subscriptions, free trial and purchases
Most features of the app need an active subscription or a lifetime purchase. Purchases are made through the App Store and are tied to your Apple Account, not to an account with us.
- Plans and prices. The available plans (for example weekly, yearly and lifetime) and their prices are shown in the app, from the App Store, in your local currency before you buy. Prices can differ by country and can change.
- Free trial. Some plans start with a free trial. If you do not cancel at least 24 hours before the trial ends, it converts into a paid subscription and you are charged the price shown at the end of the trial. Any unused part of a free trial is lost when you buy a subscription. Apple decides who can use introductory offers, generally once per subscription group.
- Payment and renewal. Payment is charged to your Apple Account when you confirm the purchase (or when a free trial ends). A subscription renews automatically for the same period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Price changes. If the price of a subscription goes up, Apple will notify you and, where required, ask for your consent. If you do not agree, cancel before the next renewal.
- Cancel anytime. Cancel in your Apple Account settings: on your iPhone open Settings, tap your name, then Subscriptions (or open Subscriptions in the App Store). You keep access until the end of the period you already paid for. Deleting the app does not cancel a subscription, and we cannot cancel it for you because billing is run by Apple.
- Refunds. Apple processes payments and refunds, and we cannot refund a purchase ourselves. Request a refund at reportaproblem.apple.com or through Apple Support. This does not affect any rights you have under the law.
- Lifetime purchase. A one-time payment that unlocks the paid features of the app on your Apple Account for as long as we offer the app. It is not a subscription and does not renew. If we ever stop offering the app, we will give reasonable notice where we can.
- Restore Purchases. If you reinstall the app or get a new iPhone, open the app and tap Restore Purchases (on the paywall or in Settings), signed in with the same Apple Account you used to buy.
5. Apple's standard EULA
In addition to these Terms, your use of the app is covered by Apple's standard Licensed Application End User License Agreement (the "Apple EULA"). If the two conflict, the Apple EULA prevails on the matters it covers. Apple is not a party to these Terms and is not responsible for the app or for supporting it; questions about the app come to us.
6. Acceptable use
We give you a personal, limited, non-exclusive, non-transferable license to use the app on Apple devices you own or control, for your own non-commercial use. You agree not to copy, modify, resell or distribute the app, to reverse engineer it (except where the law allows), to bypass or tamper with purchase checks or access limits, or to use it in any way that is unlawful or that could damage a device or hurt a person.
7. Ownership
The app, its design, sounds, text, images and the name "Speaker Rescue" belong to Denis Salaev or its licensors and are protected by law. You keep ownership of the pictures you take with dB Camera and of anything else you create.
8. Third-party services
The app works with services from Apple (App Store), RevenueCat (purchases) and PostHog (analytics). Their own terms apply to their services. How data is handled is explained in our Privacy Policy.
9. Disclaimer of warranties
The app is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties of any kind, express or implied, including that the app will remove water or dust, improve your sound, give accurate measurements, or work without errors or interruption on your device.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data or profits, or for damage to or loss of function of your device, speaker or accessories, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim, or USD 50 if you paid nothing.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or any rights you have as a consumer under mandatory local law.
11. Ending your use
You can stop using the app at any time by deleting it (remember to cancel any subscription as described above). We may suspend or end your access if you seriously or repeatedly break these Terms. Paid time is not refunded by us in that case, except where Apple or the law requires it.
12. Changes
We may change the app and these Terms, for example when features are added. The date at the top shows the latest version. If a change is important, we will say so in the app or on this page. If you keep using the app after a change, you accept the new Terms; if you do not agree, stop using the app and cancel any subscription.
13. Your local rights
If you are a consumer, nothing in these Terms takes away the protection of the mandatory laws of the country where you live.
